An ODM agent has on 29th August 2022 filed an affidavit at the supreme court seeking to support William Ruto in the Petition that was filed by the Azimio team/Raila Odinga. According to information gathered from the affidavit, the agent claimed that one of the forms attached to Azimio’s petition was fake.
Erica Atuma, the subject agent, was an ODM agent at St. Martin School Kibarage polling station 2 of 7 in Kitusuru Ward, Westlands Constituency in Nairobi County.

Mr. Atuma claims that all allegations made by the Azimio bandwagon were false, because he was present during the counting of votes. He stated that he was present at the polling station on the material day of the general elections until the end of the polls.
The agent alleged that at the close of the poll counting session, all agents received a copy of the duly signed form 34A and he immediately submitted a copy to his party – ODM – electronically.

“As an agent, I observed and took note of the tallying exercise at the polling centre immediately at the close of polls,” he said.”
“I have been shown a copy of the form 34A that we obtained from the presiding officer at the polling station and certainly not the electronic copy that I submitted to ODM/Azimio,” he claims.”
He explained that the form that appeared on the IEBC portal is identical to what he submitted. He therefore did not see any reason as to why Raila Odinga and his team would dispute the results at the Apex court.
“The form 34 A contained on page 121 of the affidavit by Arnold Oginga is neither a true copy of the form that sent to the party nor the form 34A contained in the IEBC web portal,” he claims.”
